Choosing a Forex Broker in South Africa: FSCA, FSP and ODP Explained
How South African forex regulation works, what an ODP licence means and how to check an FSP number.
South Africa has one of Africa's most active retail forex markets, and the Financial Sector Conduct Authority licenses a large number of local and international brokers. The key is understanding which kind of licence a broker holds.
FSP licence
A Financial Services Provider licence under the FAIS Act authorises a firm to give advice or render intermediary services for specified financial products. Every licensed firm has an FSP number you can search on the FSCA website.
ODP licence
Since the FMA regulations on OTC derivatives came into force, a firm that issues CFDs as principal — i.e. acts as your counterparty — must be authorised as an Over-the-Counter Derivative Provider. Many international brokers operate in South Africa as intermediaries for an offshore group company; others hold a full ODP licence locally. An ODP-licensed entity is directly accountable to the FSCA for the derivatives it issues.
How to check
- Find the FSP number in the broker's footer or client agreement.
- Search it on the FSCA FAIS search.
- Check the licence categories and whether the firm is an ODP or acts for a foreign principal.
- Confirm which company your client agreement is actually with — it may be an offshore group company.
Protections and gaps
South Africa has no investor compensation scheme and no statutory leverage cap. Complaints can be taken to the FAIS Ombud. Exchange-control rules also apply to offshore transfers above certain annual allowances.
